1. Who we are

These Terms govern your access to and use of Bugiugan Sphere websites and apps, including the BISPHER presale page (the “Service”).

2. Eligibility & jurisdictions

• You must be at least 18 years old and have the legal capacity to enter into these Terms.
• You are responsible for complying with laws applicable to you. Access may be restricted in certain jurisdictions (e.g., US/CA/CN or sanctioned countries).
• We may geo-block access where required by law or risk considerations.

3. Nature of BISPHER

BISPHER is a utility token intended for access, upgrades, governance and in-app functions within the Bugiugan Sphere ecosystem. It is not a security, share, or debt instrument. Nothing on the Service constitutes investment advice or an offer/solicitation of securities.

Crypto assets are volatile and may lose value. Smart-contract risk, market risk, network congestion and wallet compromise are possible. Do not contribute more than you can afford to lose.

4. Wallets & self-custody

• You use a self-custody wallet (e.g., MetaMask) to interact with the Service. We do not hold your private keys.
• You are solely responsible for securing your wallet, seed phrases, and devices. Transactions are irreversible once confirmed on-chain.
• Gas fees are paid by you and are non-refundable.

5. Presale rules

• Contributions are in ETH on Base. Per-wallet caps may apply and be enforced on-chain.
• Allocations, pricing, stages, vesting and claim mechanics are described in the Whitepaper and presale UI and may be adjusted for security or regulatory reasons.
• Fraudulent, manipulative, or automated participation (bots) is prohibited. We may cancel or refuse interactions that breach these Terms.

6. Prohibited conduct

• Illegal use, sanctions evasion, money laundering or terrorist financing.
• Interfering with the Service, attempting to exploit contract logic, or attacking infrastructure.
• Impersonation, phishing, or misrepresentation of affiliation.

7. Intellectual property

The Service, art, lore, branding, and content are protected by IP laws. You may use them only as permitted by these Terms or with our written consent. Players may hold NFTs or items subject to their own licenses/smart-contract terms.

8. Disclaimers

• The Service is provided “as is” and “as available” without warranties of any kind.
• We do not warrant uninterrupted, timely, secure, or error-free operation or that defects will be corrected.
• Blockchain networks are outside our control (congestion, forks, downtime).

9. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, or loss of data arising from the use of the Service or tokens.

10. Indemnity

You agree to indemnify and hold harmless the Operator and its affiliates from claims arising out of your use of the Service or breach of these Terms.

11. Changes & termination

We may modify these Terms or the Service to reflect updates, security needs, or legal requirements. Continued use after changes means acceptance. We may suspend/terminate access for violations or risk.

12. Governing law & disputes

These Terms are governed by the laws of jurisdictions. Disputes shall be resolved by competent courts , unless mandatory consumer law provides otherwise.
